Allahabad High Court declared nine people who were sentenced to life imprisonment for the murder of a youth 24 years ago in a transaction of Rs 50 as innocent. The court did not consider the statements of witnesses to be reliable. This decision was given by a division bench of Justice Rajiv Gupta and Justice Samit Gopal after hearing the separate appeals filed by accused Lalli Singh and eight others together.
The case is of Bidhanu police station area of Kanpur. On 10 July 2001, Babu alias Munshi Shyam Sundar of Sipai village had lodged an FIR against seven people of the village on the charge of murder of his son Azad. The names of Harnam Singh, Indra Bahadur, Ghanshyam, Virendra, Lalli, Jaikaran and Jhallar were included in it. During investigation, the names of Shiv Nath Yadav, Pappu Yadav, Chalu Yadav, Ram Chandra Yadav and Jhande Yadav, Shiv Kumar came to light. The plaintiff had alleged that two months ago, there was a fight between his son Narendra and Harman Singh’s grandson Dinesh alias Topilal in Sidhi market over a transaction of Rs 50 for milk.
On the night of 9th July 2001, his son Azad went to the tube well where he again had a quarrel with Harnam Singh. After this, Harnam’s son Indra Bahadur, Ghanshyam along with his friends Virendra, Lalli, Jai Karan, Jhallar attacked Azad with spear and pistol and killed him.
